Only Three Actions Matter In the Jim Comey and John Brennan Investigations
The bottom line is we need to see indictments on conspiracy charges filed outside of D.C. Nothing short of those three actions will repair the damage being done by the Epstein kerfuffle.
You are hearing and reading an avalanche of opinions concerning the recently announced investigations of former Federal Bureau of Investigation (FBI) Director Jim Comey and former Central Intelligence Agency (CIA) Director John Brennan. After an investigation into the 2017 intelligence brief on Russian election interference, CIA Director John Ratliffe referred both men to the FBI for possible perjury and conspiracy crimes. As suspected, both men pushed the false dossier written by Christopher Steele based on lies and distortions from Igor Danchanko and Charles Dolan. Lost in the noise surrounding these new investigations are the three core actions that matter when the dust settles.
First, both men actually get indicted. For nine years, we on the Right have watched as so many wrongdoers on the Left faced no consequences for their actions all the while Justice was bent for every possible infraction done on the Right. Hillary Clinton. Rob Mook. Jake Sullivan. Nellie Ohr. Glenn Simpson. Steele. Danchenko. Marc Elias. Michael Sussmann. Andrew Weismann. Dolan. Lisa Page. Peter Strzok. Kevin Clinesmith. Jim Comey. Andrew McCabe. Bruce Ohr. James Baker. Bill Priestap. Brian Auten. John Brennan. James Clapper. Susan Rice. Sally Yates. Joe Biden. And, yes, Barack Obama. So many dirty hands played a role in the bogus investigations and attempts to convict Donald Trump and members of his team. As a result, skepticism runs extremely high on the Right that there will ever be accountability on the Russia Collusion Hoax or any of the hoaxes and criminal activities taken by the above individuals and their countless co-conspirators who worked with them. The last thing we need is for Ratliffe’s referral of Comey and Brennan to be amount to more smoke with no fire. Both men MUST face indictments and criminal trials.
Secondly, the charges must include a conspiracy charge. If both men are only tried on perjury charges, it will be seen as yet another wrist slap. The key federal statute on conspiracy is 18 U.S.C. section 371 which states:
If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.
If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor.
The core focus would be on defrauding the U.S., or any agency thereof, as well as defrauding the public and committing a federal crime tied to their actions. As investigative reporter Paul Sperry suggested, at a minimum, "Brennan, Clapper, Comey and McCabe engaged in a conspiracy to commit perjury by lying in unison.” I frankly don’t care what the underlying federal crime is, any reasonable person reviewing the evidence KNOWS they conspired to defraud Trump and voters.
Lastly, the cases MUST NOT BE filed in Washington, D.C., or any other heavily-Democrat jurisdiction. As we know from the Danchenko and Sussmann cases prosecuted by Special Counsel John Durham, no D.C.-based jury will convict a Democrat or anyone who did anything to Trump. In the 2024 presidential election, D.C. voted for Kamala Harris by a 90%-to-10% margin, so any jury pool likely will be nearly all or unanimously Democrats. Democrats in D.C. aren’t just run-of-the-mill Democrats; rather, they are hard-core left-wing froth-at-the-mouth-when-it-comes-to-Trump Democrats. Brennan served as the CIA Director during the conspiracy, so his physical presence in Langley, Virginia, provides jurisdiction to file criminal charges in Virginia instead of D.C. Similarly, Comey kept classified documents at his home in McLean, Virginia, involving the Russia Collusion Hoax, which he then illegally shared with a friend. Thus, his actions also create jurisdictional grounds in Virginia. Though not much better than D.C., the possible jury pool in Virginia would certainly be more politically balanced than a D.C.-based jury pool.
Trump’s U.S. Department of Justice under Pam Bondi and FBI under Kash Patel and Dan Bongino are already suffering from a credibility issue due to the Jeffrey Epstein case. All three leaders made claims about the Epstein case that haven’t been substantiated. All three officials must clarify if they lied before taking their positions or if they are lying now. As I noted on radio earlier this week, my guess is all three individuals mouthed off about the Epstein case over the last few years as part of their fundraising activities. By firing up red meat Republicans, they increased their chances of getting those people to donate to their various causes. As in-depth reporter Julie Brown of the Miami Herald noted, "There is no client list that I am aware of. My theory is it was something conspiracy theorists cooked up to monetize their podcasts online.” Brown has spent years investigating the Epstein case. Fox News Contributor Hugh Hewitt also noted in a recent op-ed: "The internet first made it possible and then made it easy to monetize anger and conspiracy...money was being made peddling Epstein theories."
The bottom line is we need to see indictments on conspiracy charges filed outside of D.C. Nothing short of those three actions will repair the damage being done by the Epstein kerfuffle, as well as the nine years of promises made that Trump would hold those who weaponized the federal government against him and his team accountable.
P.S. In follow-up to my post on the end of the road for my beloved 2004 Honda Odyssey, last week I delivered her to Tolles Career & Technical Center so their automechanic students could use her to hone their mechanic skills. Once they are done with Red Car, the kids training to be firefighters will use her to learn how to rescue people in a burning car. I can’t think of a better way for Red Car to end her journey then by helping to educate tomorrow’s tradesmen and women. Thank you to Superintendent Todd Hoadley and his team for making this ending happen.
